Breathalyzer Test
The state of New Jersey requires anyone under the suspicion of a DUI to take a breathalyzer test. Upon receiving your license in New Jersey, drivers give consent for this test to occur, known as “implied consent.”
Refusal to take a breathalyzer test can result in you being detained and brought to a hospital where hospital staff may draw blood.
Anyone who refuses a breathalyzer test can face the same loss of driving privileges as a DUI offense. If this were to happen, reach out to The Law Offices of Jason Pollack, Esq as soon as possible, even if you aren’t charged with a DUI in Camden County or the surrounding area.
Underage DUI in New Jersey
There are different DUI/DWI laws for those under the age of 21 years old. Drivers with a BAC of .01% or higher, will be charged and can face the following penalties:
- License suspension for 30-90 days
- Possible fines and penalties depending on the details of the case
- Mandatory 15–30 days of community service
- Attendance of alcohol education and highway safety programs at a recognized intoxicated driver resource center
Ignition Interlock Device
Multiple DUI/DWI convictions can lead to an ignition interlock device being installed in your vehicle. These devices are installed to disable a driver from starting his or her vehicle if their BAC exceeds 0.05%.
Intoxicated Driver Program (IDP)
Those convicted of any type of alcohol-related traffic offense are required to participate in a program at an Intoxicated Driving Resource Center (IDRC).
